Current landscape

Rulings reshaping the right

Constitutional Court. On 23/07/2026 the Court issued Order 147/2026 and, instead of ruling on the merits of the new law's restrictions, referred the case to the Court of Justice of the European Union (CJEU). It is a significant procedural step that keeps the debate alive — but not a definitive victory.

Court of Cassation. A pending ruling on the matter is still awaited. The technical trend points to a positive impact for descendants, given the Court's favorable track record — though this does not amount to certainty in litigation.

We continue to rigorously monitor all legislative and case-law developments, adapting our strategies to best defend your rights.

Current landscape

The right remains — the timing has changed

No direct-descent right has been taken away from Brazilians. Children and grandchildren of Portuguese nationals can still obtain citizenship without having to reside in the country. What has changed is the timing — and ignoring that is a way of not being truthful with the client.

Due to the high volume of applications, cases for adult children and grandchildren are facing significant delays at AIMA and the Portuguese civil registries, which can take up to 4 or 5 years to conclude.

It's not the timeline anyone wants to hear. But it's the real timeline — and that is exactly why serious legal guidance makes the difference.

Destinations and itineraries

But starting over in another country is not just packing your bags: there's the Italian bureaucracy, the language, the residence procedures, housing, taxes, healthcare, schools. Almost all of it is a matter of planning — when every step is thought out in advance and with someone who knows the way, the move stops being a leap in the dark and becomes a calm project.

Arrival and settling in: airport pickup and initial accommodation, house hunting and reviewing contracts (contratto di locazione), entering the job market or opening a Partita IVA, enrolling children in school, family doctor (medico di base), opening a bank account, utilities, converting your driver's license, traveling with pets and Italian lessons.

One of the smartest combinations for those with European citizenship: living in Italy, with a lower cost of living, and working in Switzerland, where salaries are among the highest in the world. These are the so-called frontalieri, cross-border workers who cross the border to work and return home to Italy.

We speak frankly, because the model has rules. With Italian citizenship (or that of another EU/EFTA country) you can live in Italy and work in Switzerland — but "being able to work" is not the same as "already having a job": you need an actual position and the cross-border work permit (the permesso G).

We analyze your profile, prepare the documentation for the Swiss authorization, help you connect with employers and handle the bureaucracy and your settling in Italy. The idea is not to sell a ready-made dream, but to show you whether this path makes sense for you — and, if it does, to walk it step by step.
