On 23/07/2026 the Court issued Order 147/2026 and, instead of ruling on the merits of the new law's restrictions, referred the case to the Court of Justice of the European Union (CJEU). It is a significant procedural step that keeps the debate alive — but not a definitive victory.
Court of Cassation. A pending ruling on the matter is still awaited. The technical trend points to a positive impact for descendants, given the Court's favorable track record — though this does not amount to certainty in litigation.

These are the so-called frontalieri, cross-border workers who cross the border to work and return home to Italy.

With Italian citizenship (or that of another EU/EFTA country) you can live in Italy and work in Switzerland — but "being able to work" is not the same as "already having a job": you need an actual position and the cross-border work permit (the permesso G).
